JUSTICE AND HOME AFFAIRS

European order for payment procedure[?]

The Council adopted a common position with a view to the adoption of a regulation of the European Parliament and of the Council creating a European order for payment procedure ( 7535/06 + ADD 1-8, 10414/06 ADD 1).

The aim of the regulation is to simplify, speed up and reduce the costs of litigation in cross-border cases concerning uncontested pecuniary claims and to permit the free circulation of European orders for payment throughout the Member States. It also lays down minimum standards whose observance renders unnecessary any intermediate proceedings to be brought in the Member State of enforcement prior to recognition and enforcement.

The regulation will apply to civil and commercial matters in cross-border cases, whatever the nature of the court or tribunal. A cross-border case is defined as one in which at least one of the parties is domiciled or habitually resident in a Member State other than that of the seized court.

Denmark will not take part in the adoption of the regulation.

Bosnia and Herzegovina - Participation of FYROM in crisis management operation

The Council adopted a decision approving the conclusion of an agreement with the former Yugoslav Republic of Macedonia on the participation of FYROM in the EU's military crisis management operation in Bosnia and Herzegovina (Operation ALTHEA) (10391/06).

The agreement was signed on 3 July by Javier SOLANA, EU High Representative for Common Foreign and Security Policy and the Minister of Defence of FYROM, Jovan MANASIJEVSKI.
